Economic Freedom Fighters leader Julius Malema received a five-year prison sentence on Thursday after being convicted of unlawfully possessing a firearm, discharging it in public, and reckless endangerment.2 The 45-year-old politician is expected to appeal the sentence and will not be imprisoned immediately.12

The Congress of Traditional Leaders said the sentence raised questions about fairness in South Africa's legal system. Contralesa President Kgoshi Mathupa Mokoena noted that many people had fired shots at funerals and other events without arrest, calling it "a pity that the political career and future of this brilliant young man were almost thrown into the dustbin."1

Gun Free South Africa took a different view, with Executive Director Dr Stanley Maphosa saying the outcome reinforced the rule of law. "The firearm use in South Africa is strictly regulated and subject to consequences," Maphosa said, adding that the five sentences arising from a single incident demonstrated that "one incident can create multiple offences because firearms introduce immediate and widespread risks."1

Malema has built a political career on advocating for nationalisation of white-owned land to address the legacy of apartheid and criticising what he describes as Western imperialism.2 The EFF, known for the red overalls worn by party leaders in parliament to symbolise affinity with the working class, has attracted support particularly among disenchanted youth.2

Malema has been convicted of hate speech multiple times and was denied entry to the United Kingdom twice in the past year.2
